Under California law, wrongful death claims may be established if it can be shown that someone died as a result of another person’s conduct, whether those actions were intentional or not. The surviving partner and children of the deceased party may be able to file the lawsuit on behalf of the decedent, and even the parents of the deceased may have grounds to launch a lawsuit if there are no spouses or children. If the victim did not leave behind a spouse, children, or parents, their heirs stand to make a claim for damages.
When a family member dies unexpectedly and without notice, it is completely devastating for those closest to the victim. Anytime there is even the slightest possibility that a fatality may have been caused by someone else’s negligence, recklessness, or criminal intent, an investigation must be opened to determine if there is a right to compensation. You might be qualified to launch a lawsuit against the culpable parties for monetary damages if a loved one passes away in a car accident. What you obtain from your claim can start to make up for the income made by the deceased and can also cover your funeral and medical costs.
