According to reports from the California Highway Patrol, the accident occurred around 4 a.m. in the northbound lanes of the 101 freeway. The accident happened when a vehicle did not notice a pedestrian walking and struck the pedestrian who was walking on the side of the road.

Fatal Pedestrian Accidents in California

Unfortunately, pedestrian accidents in California are very common. Pedestrian accidents have some of the gravest outcomes, as pedestrians are especially vulnerable when involved in an accident with a motor vehicle. There is nothing a pedestrian can do to protect themselves from suddenly being hit by a car. California has some of the most beautiful weather in the country, which may be why California also has more pedestrian accidents than any other state in the country. In 2018, California reported almost 900 pedestrian deaths from accidents with vehicles, which was a 25 percent increase from 2014.

When a vehicle hits a person walking on the road, the driver of the vehicle is almost always found to be at fault. Under the law, drivers are held to a high standard of care, also called a duty of care, to avoid causing harm to others. This standard is charged to drivers because of the realization that vehicles can inflict great harm and bodily damage to others. Drivers are also charged with an especially high duty of care to pedestrians. Drivers must maintain a proper lookout for pedestrians and operate their vehicles in such a manner to maintain control and avoid hitting or causing harm to a pedestrian on the sidewalk, crosswalk, road, or wherever else they come in contact with the pedestrian. This duty of care is breached when a pedestrian is hit by a car.
