Hit-and-Run Accidents in California

Accidents on California highways happen every day and at all times of the day. They are often very serious, due to the high speeds that cars travel. California has many freeway systems with multiple lanes of high-speed traffic. California has some of the busiest roads with the longest commutes in the country. As such, drivers often travel above the speed limit to reduce their commute times. Speeding is a serious problem in California and reckless driving, in general, is the number one reason car accidents happen.

California law states that when involved in an accident, the parties must pull off to the side of the road at the accident scene to exchange information with the other parties. However, there is an increased number of drivers who are breaking the law by fleeing from accidents they’ve caused. Drivers often flee an accident when they have broken the law, for example, by driving impaired, driving with a suspended license, or not having insurance. Failing to stop at the scene of an accident is punishable as either a misdemeanor or felony offense, depending on the severity of the circumstances.

Being in a car accident is very stressful. If the other driver doesn’t stop and exchange information with you, it makes the situation that much more difficult. If you’ve suffered injuries, you may worry about how you will pay for your medical care, and expenses, and how you will support yourself if your injuries are severe and you can’t work for some time. Victims of hit-and-run accidents can receive compensation for their medical expenses, lost wages, and pain and suffering, even if the at-fault other driver leaves the scene and isn’t ultimately apprehended. This coverage is under California’s uninsured motorist coverage (UM) which each driver has under their insurance policy. The victim in this situation would file a personal injury claim with their own insurance company. Even though you’re filing a claim through your insurance coverage, you can still have issues receiving fair compensation. The insurance company may try to short-change you and not give you what you are fully entitled to. It’s important to still speak to a knowledgeable attorney who will fight for your best interest.

If you were injured in a hit-and-run accident you should speak to an experienced car accident lawyer right away, who will walk you through the process of submitting a claim for compensation. Contact a Santa Ana car accident attorney by calling (888) 539-3154 to see how we can help you.
