California law clearly states that when an accident occurs, the vehicles must pull off the road, if able to, at the scene of the accident. Oftentimes, driver flees the scene when they have engaged in other illegal activities. Failing to stop at the scene of an accident is punishable as either a misdemeanor or felony offense, depending on the circumstances. If you’ve been involved in a crash with a driver who flees the scene, there are a few things, if you’re able to do, which can help your ability to recover a settlement. These steps are to:
Being involved in a traffic accident is a stressful situation, but if the other driver doesn’t stop and exchange information with you, it can cause more stress and difficulties. Particularly, if you’re injured in the accident, you may be worried about who will pay for your medical care, expenses, and lost wages if you can’t work. Many victims of hit-and-run accidents don’t know that they may still receive compensation from the insurance company for their medical expenses, lost wages, and pain and suffering as a result of the accident, even when the at-fault other driver leaves the scene. This is typically covered under California’s uninsured motorist coverage (UM). It’s important to contact an attorney who can help you with this process and negotiate with the insurance companies on your behalf.
If you or a family member were in a hit-and-run accident you should speak to an experienced car accident lawyer right away, who can walk you through the process of what is to come and help you understand your rights and what you may be entitled to as compensation for your suffering.
