San Diego, CA – Man Fatally Struck by Car While Changing Tire on I-805

San Diego, CA (October 8, 2022) – On Thursday morning, October 6, an accident was reported in San Diego involving a pedestrian and a vehicle that tragically resulted in the pedestrian’s death.

According to reports from the California Highway Patrol, the accident occurred around 3 a.m. in the southbound lanes of Interstate 805. A person’s vehicle had incurred a flat tire, so they pulled their vehicle off the road into the right shoulder area to change the tire. While changing their tire, the person was standing next to their vehicle, when a Toyota Camry, which was driven by a 22-year-old San Diego resident, crashed into the person. The CHP reported that the driver stopped immediately.

Paramedics were immediately called and arrived on the scene within minutes and assessed the pedestrian’s injuries and provided medical care. The pedestrian sustained very severe injuries. Sadly, the person’s injuries were too serious, and the person was pronounced dead at the accident scene. The pedestrian’s name has not been released at this time. No one else was injured as a result of the accident. The driver of the vehicle remained at the scene and was cooperative with the police.

Police are still investigating the circumstances leading up to the crash. The southbound lanes of the freeway were closed for several hours as police conducted their investigation.

We extend our deepest condolences to the family of the deceased victim at this time. Our thoughts are with all those who have been affected by this tragedy.

Fatal Accidents in California

Experiencing car troubles is something that happens to everyone at some point in their life. While you do everything you can to take care of your car and maintain it properly, sometimes, there’s nothing you can do to prevent your car from having some kind of maintenance issue. No one ever wants to have car troubles when there are out on a busy road or a trip, but for many, this is the reality. Sometimes, you hit a pot-hole or some kind of other debris in the roadway, such as a nail or screw, and it causes your tire to go flat. Out of necessity, you pull over to the side of the road and change it. Sadly, oftentimes, this situation quickly becomes a tragic event when the other drivers on the roadway don’t give you enough space to fix your vehicle. The news headlines all too often report on people who are tragically killed on the side of the roads while trying to change their tires.

When a vehicle hits a person on the road, the driver of the vehicle is often found to be at fault. Under the law, drivers are held to a high standard of care, also called a duty of care, to avoid causing harm to others. This standard is charged to drivers because of the realization that vehicles can inflict great harm and bodily damage to others. Drivers have a duty of care when approaching cars on the side of the road, whether someone is changing a tire or just pulled over. If you see a car pulled over, you should move your vehicle into the center lane to give them extra room. If there is too much traffic and there is no way to move over, you should slow down and drive slowly passed the vehicle.

If someone you love was killed in an accident, you can file a wrongful death suit seeking compensation for damages, which may include medical expenses, funeral expenses, lost future income and benefits, pain and suffering, emotional distress, and loss of companionship. While no monetary value can replace your loved one’s life, filing a wrongful death suit can bring closure and help ease the stress of any financial burdens caused by their death. Insurance companies have strict filing deadlines, so you will want to speak to an attorney soon.
