Fatal Pedestrian Accidents in California

The Pacific Coast Highway, also known as State Route 1, is a scenic drive along California’s Pacific Coast. It is a 656-mile highway and is one of the most famous routes in the country that both locals and tourists flock to for its scenic, panoramic ocean views. The Pacific Coast Highway is also used daily for Californian’s commutes. As a result of all this traffic, the Pacific Coast Highway also has its fair share of accidents each year.

In California, there are more pedestrian accidents reported than in any other state in the country. Because of the beauty of the state and the availability of outdoor activities, pedestrians are often involved in accidents. Pedestrians are at an increased risk of suffering severe injury or death when hit by a vehicle because they are defenseless and have no way to shield themselves from sustaining injury.

Because of the prevalence of accidents involving pedestrians, California has enacted a set of pedestrian favorable laws to try to reduce the number of pedestrian accidents in the state. California law states that a driver must yield to pedestrians at all crosswalks or intersections. Failing to do so and yield the right of way to a pedestrian will likely cause the driver to be held liable for any accident that results. California law further states that if an accident occurs, the vehicles must pull off the road, at the scene of the accident.

If someone you love was killed in a pedestrian accident as a result of someone else’s negligence, you may be able to file a wrongful death claim seeking compensation for damages. Such damages may include medical expenses, funeral expenses, lost future income and benefits, emotional distress, and loss of companionship. Losing a loved one is one of the hardest things to experience in life. While no amount of money can remedy the pain of losing your loved one, a wrongful death suit can bring justice and closure and help ease the stress of any financial burdens caused by their death.
