A wrongful death suit is a claim in civil court against another party for causing a person’s death. There are specific rules regarding who can file the claim on behalf of the deceased individual, but usually, it is a close relative or executor of an estate that files the claim. There are two requirements that you must prove to successfully pursue a wrongful death lawsuit in California, which are:

  1. You must prove that the negligent, reckless, or intentional act of another person caused the death of your loved one.
  2. There must be quantifiable damages that were caused by your loved one’s death.

If you can prove the above two items, you may be eligible to recover compensation.
