$735,000 Verdict Reached in Auto Accident Case

We at Russell & Lazarus are pleased to report that attorneys Marc Lazarus and Robert Simon of our firm obtained a verdict in Riverside Court of $735,546.24 in an automobile personal injury case. The case was challenging, for the defense tried to argue against a verdict based on the Plaintiff’s pre-existing condition.

The Case

Mr. Lazarus and Mr. Simon represented the 74-year-old Plaintiff, who had suffered neck injuries following a collision in which she was rear-ended. Her injuries were significant enough that she underwent cervical fusion surgery after suffering with considerable pain. The Plaintiff does not speak English, and along with age, has a pre-existing condition.

The Defense fought hard to prevent our Plaintiff from recovering damages, arguing that her pre-existing condition was the cause of her needing surgery, and not the accident their client clearly caused. We had demanded $600,000 in compensation, and were offered a mere fraction of this at $200,000. The plaintiff’s medical expenses, alone, totaled $154,546.24.

The Verdict

The Defense was evidently confident that the jury would find in their favor, but we are pleased to say that justice prevailed for our client. The jury found that the collision was the substantial factor, not only in bringing about the Plaintiff’s past and future pain, but also for the necessity of surgical intervention, along with the need for future medical care. The jurors voted 12-0 in favor of our Plaintiff on all questions, and even hugged her and our attorneys after the verdict was read.
