A 44-year-old father of three underwent lower back surgery for the aggravation of a pre-existing back condition after his foot went through the upper balcony walkway at 6 AM, just as he was leaving for his construction job. The management of the building had repaired a hole in the walkway caused by erosion, and had failed to secure it with plywood but instead used only a “patch” kit. It was an accident waiting to happen. The insurance company for the apartment complex denied the claim on the basis that the client knew the area had been repaired and should have not walked over it. A lawsuit was then filed and on the eve of trial, after three mediation hearings, the claim was settled for $500,000.
