The Case

The little girl went with her father to the fitness club so he could sign up for some classes. While he was standing at the desk filling out the paperwork, the metal cabinet suddenly fell over, killing his daughter in front of him. When the lawsuit was filed, our attorneys learned that the cabinet was not secured to the wall and that employees had warned the owner about the dangerous condition for several years, but nothing had been done to remedy it.

Offer and Settlement

After the lawsuit was filed, the insurance company offered the $1 million insurance policy in settlement. Upon conducting an asset investigation, our attorneys learned the owner’s assets would likely be protected in any filed bankruptcy. They then negotiated with him, reaching an agreement in which he agreed to pay $100,000 on top of the $1 million policy. Our attorneys then negotiated with the city of Lake Elsinore to erect a memorial for the girl. As a result, Russell & Lazarus were allowed to secure a bench to be installed next to a playground in her honor.
